Evolving issues concerning the Internet are beyond the responsibility or control of bootcampcoffee.com. We cannot assume liability for delays, failures or data transmission related to the Internet. Be assured that we take all necessary steps to keep the service downtime to a minimum and that we use secure server software to ensure your transactional security and privacy.

Initial Purchase

“Initial Purchase” refers to the first payment after you purchase the courses.

Membership

Membership refers to the period after the initial purchase period has expired. It is discounted and keeps your older content accessible, while allowing access to new content at your membership level.

Membership

When you purchase your first course at bootcampcoffee.com your credit card is charged the initial purchase price, which comes with a specified membership period.
Your credit card will be automatically billed for each successive month or year at a lower membership rate unless you cancel the membership. All sales are final; there are no refunds. Bootcamp Coffee reserves the right to change pricing effective with your renewal date.

Certification

You can become certified depending on the package you purchased. Certification requires that you obtain a minimum score of 80%. The Certificate will have your name and it will be emailed to the email used for registration.

Support

Bootcamp Coffee offers subscribers email support in relation to problems with logging on to the system and queries about subscriptions.
Support can be accessed Monday to Friday between 9 AM to 5 PM Pacific Time.

Cancellation

You may cancel your Membership at any time. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL-MONTH MEMBERSHIP PERIODS. To cancel, go to the bottom of your Members’s Page (the first page which appears after you log in) and press “Unsubscribe” if asked confirm again. Alternatively you can cancel recurring payments at PayPal or at your credit card company.

Outstanding Paypments

bootcampcoffee.com has the right to limit and or cancel the membership of a member who has an outstanding balance due to missed or incorrectly submitted payments or payments with error of any kind. Cancellation or account limitation does not discharge payment obligation.

Updates

Subscribers and users can choose to opt out of receiving email notification of Website updates. Subscribers and users can unsubscribe from email notification and any other email communication sent to bootcampcoffee subscribers at any time. Please see our Privacy Policy for more details.

Intellectual Property Rights

The contents of bootcampcoffee.com, including all text, graphics, images, logos, button icons, photographs, editorial content, notices, software (including html-based computer programs) and any other materials are protected under the United States Federal trademark and copyright laws. Any distribution, reprint or electronic reproduction of any content from bootcampcoffee.com in whole or in part for any other purpose is expressly prohibited without our prior written consent.

Boot Coffee may terminate its legal agreement with you at any time:

*if you have breached any provision of this Agreement or act in a manner which clearly shows that you do not intend to, or are unable to, comply with the provisions of this Agreement;
*if Boot Coffee in its sole discretion believes it is required to do so by law (for example, where the provision of the Service to you is, or becomes, unlawful); or
*immediately upon notice to the email address provided as part of your Registration Information.

bootcampcoffee.com may provide links to other websites as a resource. We cannot be responsible for the content for such websites, nor can we make any warranties regarding these sites.

Boot Coffee may at any time, terminate its legal agreement with you:
*if you have breached any provision of this Agreement (or have acted in a manner which clearly shows that you do not intend to, or are unable to comply with the provisions of this Agreement);
*if Boot Coffee in its sole discretion believes it is required to do so by law (for example, where the provision of the Service to you is, or becomes, unlawful); or
*immediately upon notice, to the email address provided by you as part of your Registration Information.

Governing Law and Forum for Disputes

This Agreement, and your relationship with Boot Coffee under this Agreement, shall be governed by the laws of the State of California without regard to its conflict or choice of laws provisions. Any dispute with Boot Coffee, or its officers, directors, contributors, managers, volunteers, employees, agents, sponsors, or affiliates, arising under or in relation to this Agreement shall be resolved exclusively through the small-claims court of the Superior Court of California within the county of Marin, California, except with respect to imminent harm requiring temporary or preliminary injunctive relief in which case Boot Coffee, LLC may seek such relief in any court with jurisdiction over the parties. You understand that, in return for agreement to this provision, Boot Coffee is able to offer the Service at the terms designated and that your assent to this provision is an indispensable consideration to this Agreement.
You also acknowledge and understand that, with respect to any dispute with Boot Coffee, its officers, directors, managers, volunteers, contributors, employees, agents, sponsors, or affiliates arising out of or relating to your use of the Service or this Agreement:

YOU ARE GIVING UP YOUR RIGHT TO HAVE A TRIAL BY JURY; and YOU ARE GIVING UP YOUR RIGHT TO SERVE AS A REPRESENTATIVE, AS A PRIVATE ATTORNEY GENERAL, OR IN ANY OTHER REPRESENTATIVE CAPACITY, OR TO PARTICIPATE AS A MEMBER OF A CLASS OF CLAIMANTS, IN ANY LAWSUIT INVOLVING ANY SUCH DISPUTE.

Limitation of Liability

BOOT COFFEE, AND OFFICERS, DIRECTORS, CONTRIBUTORS, MANAGERS, VOLUNTEERS, EMPLOYEES, AGENTS, SPONSORS OR AFFILIATES, ARISING UNDER OR IN RELATION TO THIS AGREEMENT WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
